These Terms and Conditions ("Terms") govern your use of the Digital MegaMart website digitalmegamart.com and mobile apps (customer, delivery and seller apps), together the "Services", operated by Digital MegaMart ("we", "us", "our"). By accessing or using the Services you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract under Indian law to create an account and place orders. By using the Services you confirm that you meet these requirements.

2. Your account

• You must give accurate and current information, including a valid mobile number, when you register.
• You are responsible for keeping your password and OTP confidential and for all activity under your account.
• Tell us immediately at admin@digitalmegamart.com if you suspect unauthorised use.

3. Our role

Digital MegaMart is an online marketplace. Stores and sellers list and sell products on the platform and are responsible for their products, their descriptions, prices, quality, stock and legal compliance. Delivery partners deliver orders. Except where stated otherwise, the contract of sale for a product is between you and the seller.

4. Orders, prices and availability

• Placing an order is an offer to buy. An order is accepted when the seller confirms it.
• Prices, delivery charges, taxes and offers are shown at checkout. Product images are for illustration, and actual products may vary slightly.
• A seller may cancel an order if an item is out of stock, mispriced or unavailable, in which case you will be refunded any amount paid.
• Delivery times are estimates and may change due to traffic, weather, high demand or other factors outside our control.

5. Payments

• We offer Cash on Delivery and online payment options, which may vary by location.
• Online payments are processed by third-party payment gateways, and their terms apply. We do not store your card or banking credentials.
• For Cash on Delivery orders, please keep the exact amount ready. We may restrict Cash on Delivery for accounts with repeated refused or undelivered orders.

6. Cancellations, returns and refunds

Cancellations, returns, replacements and refunds are governed by our Cancelation Policy, Refund Policy and Shipping Policy available on this website, which form part of these Terms. Refunds, where approved, are made to the original payment method or as wallet credit, as shown in the Refund Policy.

7. Acceptable use

You agree not to:

• use the Services for any unlawful, fraudulent or abusive purpose;
• give false information, impersonate any person, or create accounts to misuse offers or referral rewards;
• harass, threaten or abuse sellers, delivery partners or our staff;
• interfere with, scrape, reverse engineer, or attempt to gain unauthorised access to the Services or their security;
• upload harmful code, or post content that is unlawful, misleading, offensive or infringes another person's rights;
• sell or order products that are illegal or restricted under applicable law.

8. Sellers and delivery partners

If you register as a seller or delivery partner you also agree to provide accurate business and identity details, comply with applicable laws (including food safety, tax and consumer protection rules where relevant), follow our onboarding and operating guidelines, and accept the commission, payout and settlement terms communicated to you at registration. We may suspend or end your access if you breach these Terms or our guidelines.

9. Reviews and content

You are responsible for the content you submit, such as reviews, ratings, photos and messages. You grant us a non-exclusive, royalty-free licence to use that content to operate and promote the Services. We may remove content that breaks these Terms.

10. Intellectual property

The Services, including the name, logo, design, text and software, belong to Digital MegaMart or its licensors and are protected by law. You may not copy, modify or reuse them without our written permission, except for personal, non-commercial use of the Services as intended.

11. Offers and referrals

Coupons, discounts, wallet credits and referral rewards are subject to the terms shown with each offer. We may change or withdraw offers at any time and may cancel benefits obtained through misuse or fraud.

12. Disclaimer

The Services are provided "as is" and "as available". To the fullest extent permitted by law, we do not guarantee that the Services will be uninterrupted or error-free, or that product descriptions, prices or delivery estimates will always be accurate. We are not liable for the quality, safety or legality of products sold by sellers, beyond what applicable law requires.

13. Limitation of liability

To the fullest extent permitted by law, Digital MegaMart will not be liable for any indirect, incidental or consequential loss arising from your use of the Services. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits any right you have under applicable consumer protection law.

14. Suspension and termination

We may suspend or close your account if you breach these Terms, misuse the Services or where required by law. You may stop using the Services and delete your account at any time as described at https://digitalmegamart.com/account-deletion.

15. Privacy

Our Privacy Policy explains how we handle your personal information and forms part of these Terms.

16. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of the Services after a change means you accept it.

17. Governing law and disputes

These Terms are governed by the laws of India. Subject to applicable consumer protection law, the courts at Kolkata, West Bengal have exclusive jurisdiction over any dispute arising from these Terms or the Services.
